Generally no, it's not legal. I think it's mainly a safety issue inforced by fire code.

That makes sense. I think I need to do more research because I'm looking for some sort of solid code or law. The 25 unit building I live in has about 4 smokers, and they actually smoke IN the elevator. The problem is, two of them are the property managers.

You could contact the Department of Public Health in your county and they could address the problem. Have you tried to contact the property owner?
