I need help asap. My son has been charged with contracting without a contractors license. Before the mortgage market had took a dive he started selling modular homes. He check with several suppliers and they all said he did not have to have a contractors license to do the business he just needed to have a contractor to oversee the finishing of the homes once they were shipped to the site. He contacted several contractors that agreed to assist him in putting up his homes and he obtain his business license to sale the homes however now he has a charge against him of contracting without a professional license by the state. Keep in mind he does none of the work on the homes they are modular and built at a plant and then shipped to the site and he subs out all the work that is done on the homes to complete them once they reach the customers land. He also gives the customer the option to do hire their on contractor or finish their own home to save money. This case is against him in Virginia. Has he commited a crime? and is there anything that can get this charge dismissed?

It is very likely he is wrong. It looks like he was conducting the business without a proper license.
