Advice on how to proceed?
A drunk driver hit me in 2009 and registered a .19 BAC. I hired an attorney and went to many doctors to get my injuries taken care of. Early last year the driver's insurance company offered to settle with a low amount. We decided to deny it unless they could come up with a better offer.
The insurance company hired a defense attorney, he asked for all the documentation which we promptly supplied. Now my lawyer has said that the defense attorney has not returned his phone calls. Another piece of information, the defense attorney and insurance company have not been able to locate their driver. (presumably he is in jail in another state).
My attorney does not want to pressure the defense attorney because he fears that the insurance company will try to get a motion to deny coverage of their drunk driver.
It has now been 6 months since anything was heard from the defense attorney. I feel it is time to set a court date. My lawyer wants to wait and see if the defense attorney decides to return his calls.
Any advice? If you need any other information then let me know! This is in the state of Virginia. We are seeking medical compensation.
