What state did this occur in?
New to this site and not sure how it works but here I go! Last night I was told by my server at a comedy club she can only serve me bottle water, no tap, even after I drank and paid for three glasses of wine. Is this actually legal? I thought that law states where alcohol is served drinking water must be available whether a drinking fountain or cup of water. I did purchase a aquafina bottle of water for $3. Not Cheap just can't justify the refusal of service!

I'm not sure about that... I have heard that some restaurants only sell bottled water, perhaps it is because their tap water isn't good enough = no permit to use it for drinking or something like that.
"In Washington State we have places that will hand out bottled water to people after they have had too much to drink. This is weird, however, they are not charged for the water. I think maybe they keep track of it another way.... as far as how many people are given water after they are being cut off or something. I think that is radiculous that you would have to pay for it... if you go in the dining area you could get a glass of water for free...."

I've come to this forum in search of an answer for this similar instance:
Last night, a bar/club that we had been at turned into a dance club after liquor service stopped, or "last call". The dancing accelerated the alcohol, and my friend got dizzy. I was told I had to pay for a bottle of water. I generally refuse to purchase bottled water, so I asked for a glass/cup that I could fill using a darned faucet in the bathroom or something. (probably wouldn't have, but I wanted to make a point.)
the details: In Washington state, paid a cover to get in, purchased two drinks before 2 a.m., was told the charge for water was the way to pay the DJ, and there's no food available at this establishment (which I believe is a violation of WA liquor law).
In this situation can you be refused tap water?
1. Pay the fee and skip the tip. It is my policy.
2. You might check with the local code enforcement officials for restaurants and bars on the law since they are usually knowledgable.
3. Ask to see the manager and ask him about his policies? If the answer is not satisfactory, vote with your wallet. Do not return. Tell your friends, tell MADD, tell the newspaper. Stick to the facts, do not embellish and slander the owner.
4. Forewarned is forearmed. The next time you order drinks, ask for a glass of water with the order. If refused, see 3 on the manager and then leave the establishment. I walk out of restaurants that do not server free tap water with a meal.

I was refused free water with my sandwich at Subway by an employee. I then informed him that, in Tennessee, unless a restaurant has a water fountain, it is illegal to refuse water. He said that if it were up to him, that he would give me the water but his boss told him to do otherwise. I then told him that it is not up to his boss or him.
That got me thinking. If he cannot prove that his boss told him to do that, is he responsible for violating my rights?
