There is a deaded 'Right of Way' across my property. Do I, as the owner, have any way of regulating the speed at which people transgress my portion of the 'Right of Way'? The 'Right of Way' was deeded in the early 1800's so it seems that I should be able to post a 10 MPH speed limit that would be appropriate to that time. I have livestock on both sides of the single lane dirt way and children, domestic animals and dust which are my concerns. I understand that I am required to maintain the Way as "passable". Does this imply: as appropriate to the time that the 'Right of Way' was granted or do I now need to make the way a speedway?
