    Default Car damaged while at repair shop!!!

    I recently bought a car to fix it up and sell it.Took the car on the 16th of February for inspection. They said i needed brakes and rotors. Got it done and while i was leaving the car had another problem on Feb. 19. I took it right back to repair shop, as i was only a mile away. Drove right back into repair shops bay. Told them there was a electric problem and to give me a quote on replacment struts.Told themthat i was in no rush for car to get fixed so i could wait for them to look at it. This is a repair shop that i frequent and know some of the guys that actually do the work on cars. It snowed in NE PA last week. They did not get to look at it early last week because they were busy and with the snow were shutdown in the later week. Looked at it this Monday and told me to come pick up car as they could not duplicate the problem. They do not specialize in electrical work. Went to walk up to car and noticed a good amount of damage to rear of car. Went in to office and they basically blew it off as it was a third party matter and they don't know how it happened. They began to say that ther insurance does not cover the lot, just the garage. As they were trying to implicate it happened there. But could not say when or where it happened for sure. I have read up on the matter of Laws of Bailment and believe they imply in this situation. They were clearly negligent in not securing the vehicle in the garage in my opinoin. I would like some input on this situation. Thank you in advance

    To my knowledge, Regardless if THEIR insurance covers the lot or the garage they are responsibly for any damage that occurs to any car under their care. I believe strongly that you have a case against them and they have to get the damage caused to your car, while in their care, fixed.

    Default what happened?

    Can you tell me, did you find out if you had a case? I just picked my van up from the repair shop tonight and there is a huge scratch in the back bumper. The owners could not tell me what happened and told me they were not responsible. My van is not brand new but I took very good care of it, this is very upsetting and I would like someone to pay for the repairs that they caused.
    If you could let me know what happened in your case I would very much appreciate it.

    Default I Won!!

    I actually just recieved the judgment from my local majistrate. Judgement came in my favor. I presented my case basically as described in my first post. The Laws of Bailment were in my favor. Majistrate said it was word against word because they were saying that they had no knowledge of what happened. But like S-Cone said they were responsible for the care of my vehicle. It is on the person you are suing to prove that the car was damaghed like that prior to you leaving the vehicle. If your vehicle is newer i cannot see you having a problem. As mine was an older neon with some damage. The most important thing i was told was to utilize my local majisrtate. Hope this helps!!!

    well what i learned in my experience regarding with this car shop, i monitored their work so that i will not be ripped off. and actually not all auto shops in PA do that thing. i know a Pennsylvania auto repair where they have good service. heard about 101 Auto Repair?
