I received my "discovery" packet in the mail today and the interview between me and the officer was NOT the entire report. Do I have legal right to get a copy of the statement? It was hand written by the police officer. Another question I had was the plaintiff used my cell phone to call the police department to report that this whole case was a mistake on his part. He dialed 911 first because he did not know the police departments phone number. 911 transferred the call to the state police, who then transferred the call to the city police department. He then turned around and said that himself placing that phone call was a mistake and he did not know what to do because he was confused. The police department and my attorney won't (for some reason) look up the records of the before mentioned phone call which was recorded from the police department. All calls that go through the police department here are recorded. What should I do? I have a public defender because I can't afford an actual attorney.
