If you hold the deed, you are the owner. There should not be a problem. When you bought the house the keys should have been available to you. Try and speak directly to the mortgage holder/ lender again. Good luck!

Hello, Here is my story, so please bear with me. Sept 22 2011 we bought a home at a tax sale. It has a mortgage, and we were aware of this mortgage. We figured we would just redo the mortgage, or get a new one to pay off said mortgage. The person who is the "borrower" has been deceased for over 2 years now. We, as the deed owner/homeowner, cannot talk to the mortgage company because we are not the "borrower" Fine, I understand privacy rights and whatnot.
Our problem right now is, we, as the current homeowner/deed owner, cannot get our house keys. The deceased borrower has an exectutor who tells us they will not give us, the homeowner/deed owner, the keys because they are the borrower, and they have more rights to our house keys then us. We want to take care of the mortgage, we are not trying to "skip out" on it. We want our keys so we can start repairs on the home which are pretty bad. what are our rights as the homeowner/deed owner so we can get our keys and begin the repairs so we can move in. We are in the process of getting a mortgage to pay off the mortgage already in place.

you need to divest the mortgage with a quite title action, this will clear the Mortgage and give you a clean title/deed
