My daughter was at a birthday party with some other kids, all teens. There was an atv (four wheeler) there and my daughter and her friend rode the four wheeler (without permission). My daughter drove it up the hill with her friend as a passenger. They switched places with my daughter as passenger and her friend driving. The friend wrecked it.
Since my daughter wasn't driving I was told she (or me and her mom) are not liable for damages. My daughter is very good friends with this girl and the whole family. My wife and I are pretty close to them. If we are not responsible and pay nothing this will get really ugly dealing with the other family. Are we liable for these damages? and if not do we pay 1/2 to keep the peace between the two families?

I believe that the 4-wheelers owner homeowners insurance should cover all damages and repairs minus the deductible. What I think if they are gracouis enough to use their homeowners u and the other child's parents split the deductible. Cause they could of always filed criminal charges against your daughter and her friend.
