Hi I took a contractor to court is Lackawaxen,PA and won a judgement against him for $847.00. He appealed the decision. I then had to go to Pike County court of appeals. Here I was told I have to file the complaint again as if I am starting case all over. I did this within the 30 day time frame from his appeal. I then sent the contractor a Cerified letter which he signed for. I also went to his place of business and handed him my complaint. I didnt want to hear I never received it. Well my wife then brought to Pike County court of appeals and handed in he Proof of service documents. The certified mail receipt and the statement of hand delivery. My wife asked the clerk what is next. She stated that she cant give legal information. She then told my wife you will probably never get your money that it could stay in the Appeals court of Pike County forever. I dont understand this. Will I receive a court date or a decision. If in fact the appeal is in limbo can I serve the contractor a demand payment letter and file for no payment of a judgement. A lawyer wanted $1,500 to represent me on this which didnt make sense to hire for a $847.00 judgement. I really dont know what to do know. HELP!!
