In 2001, we purchased a "time share". It was actually non-deeded vacation weeks. We paid it off quickly and shortly thereafter found out that they were doubling our maintenance fees. We called and protested this because it was not supposed to increase more than inflation. When they refused to lower them we cancelled by phone and by certified mail. Since it was not deeded and the weeks themselves were paid off this should have been sufficient.
June 2010, I received a phone call from Meridian Financial stating that they were trying to collect this debt. I told them about the cancellation and also about the fact that both my husband and I had ended up in a non-asset bankruptcy after and they still continued to call. They also called the bankruptcy atty who confirmed the bk and I never recieved anything by mail from the collectors.
I applied for credit and was refused last month. After pulling my credit, I found out that this collection agency has split this one account into 3 separate accounts and placed 3 collections on my report. For each year that they charged us maintenance fees, they placed it as a new account on my credit report.
I also recieved an invoice on this "debt" that shows that the charges on this account are for maintenance fees from 1/1/2004 on. Isn't this disputed debt time barred?
They refuse to remove it and after my dispute with Experian, they confirmed the debt.
I made a complaint to the FTC who stated that they do not handle things on an individual level. And now I've made a complaint to consumer affairs.
Is what they are doing legal? What else can I do? I need help please! I feel like they are trying to extort me for something I do not owe.
