4 days beforehand I had bought a pen from this shop that when you pulled the back off, it revealed a 2 and 1/4 inch blade. Also in between my iphone and its case i carry a small bare exacto blade just for daily jobs or circumstances when i need you cut something open but I don't feel like carrying around a box cutter so I've kept it inside my phone case for months without any problems. I bought the pen knife on saturday and on tuesday I was pulled from class because someone who has close connections with the principle knew down to the very last detail where I keep all these blades. They searched me and found them within 30 seconds and was immediately arrested and patted down and had all my pockets and possessions gone through thoroughly.. Normally this would be classified as an automatic expulsion but since I have a psychological background and have been seeing a psychiatrist and psychologist for over a year now they're treating me as an exceptional student. I am being charged with possession of a deadly weapon and am suspended for three days along with possibly having to go to an alternative academy for special ed's and juveniles for 45 days. I will also be put on probation, have to go to court, and take consistent drug and alcohol testing even though that was irrelevant and I dont do either of these things. I have had a perfectly clean slate for the past two years and i am a junior in high school. I have made honor roll the past 4 marking periods. I have severe paranoia, OCD, depression, anxiety disorder, panic disorder, bipolar disorder II, psychosis, and I only had it because i feel like i am always going to be put in a life or death situation. In Act 26 of the Pennsylvania State Law for Safe Schools it paraphrases if a special education student is found with a pocket knife or shorter than 2 and 1/2 inches then it does not count. An exacto blade is authorized as kids in wood and metal shop use them daily. What choices am i faced with here. I have my doctor and therapist speaking for me at court along with my background of no violence and great grades. I never pulled out either blade, i never pulled it on anyone or even showed anyone and I have very few friends, do they have the right to search me like that off of a blunt accusation and patt me down and search me? I was targeted on purpose by someone within the school district. I had absolutely no civil rights and that shocks me that they can do that. and is it legal for me to have to be drug and alcohol tested for something like that? even though the situation had nothing to do with either of those items. (Not that it matters, its just like someone getting put in a psych ward for stealing candy from the supermarket, its completely irrelevant and unnecesarry) and Will the 2 and 1/4 inch pen blade not qualify then as they are claiming me to be under the label of Special Ed. Any information asap would be amazing my hearing is on monday for the school but my court date isnt for a few weeks.
