I was verbally assaulted at work by a male co worker. I went to my manager who told me to go away. I tried to continue with my job but the verbal abuse continued. Things escalated into a shouting match. I wrote an incident report and was told today to find another job. I like my job and want to keep it. do I have any recourse. I also think that the names I was called could be considered sexual harrasment as he would not have called another man the names he called me.
Is it a Mom and Pop shop or if it's a large Corporation is the Question ? (Doesn't matter if you are female or gay)
Either way it doesn't make it right - what happened to you , but the politics are vastly different. Some good old boys stick together, some run scared when the head office calls 'em on their BS, and I assure you that if your boss was female it would not have gotten this far. So remember sexual harrassment is a just cause and people have to be reminded of it on a daily basis. It is your boss' fault therefore the Company's.
Therefore write them a letter and get your boss'/co-worker's response in writing - and if they are half as ignorant as you say they will step in their own BS and POOF - you will have a winnable lawsuit on your hands,and a pro bono attorney will take your case.
Use actual facts that he was privy to - (ask him or the actual co-worker /or both) to explain his inability to diffuse the situation as a manager,(maybe the co-worker who had the problems-will use verbal abuse in the responding letter) Remember be nice- it pisses them off terribly and hopefully he/they will show the world his/their true colors- providing your attorney with
ammunition to move in for the kill. If on good terms with any workers witnessing the exchanges that's very helpful too- Request Depositions as part of Discovery-Rule 26(b) subsection 3 of the Rules of Civil Procedures. If Both are insensitive or Rude in their responses and actually abuse you verbally -it will be actionable= Good Luck...God Bless
