i know that common law is no longer recongnized in the state of pa. but what about those that entered into in it before the new law?
i have been with my common law spouse since the year 2001.
what if one party refuses to admit to common law?
The Legislature passed a law, effective in December,
2004, which abolishes new Common Law Marriages in Pennsylvania. This law effects any
Common Law Marriage which would begin AFTER January 1, 2005. Any Common Law
Marriage which began on or before January 1, 2005 is still valid.
If one person denies the common law marriage then it does not exist.
