Is it legal for a small business to charge a percentage rate on credit card purchases?

I have been looking through all the previous questions and hardly anybody answers!
It is kind of incredible that some questions have had over 1,000 people look and only
4 responded. Really? I am not sure how helpful this site really is?

Tony, I can only venture a guess as to your inquiry. I would think that there are a bunch more folks who need free legal advice than ther are attorneys willing to give free legal advice. Therefore, there are many lookers and "takers" but few givers. Hope this helps.

Good question. My expertise is NOT consumer law but let's look at this logically together. Generally, there is a legal dictum called "freedom of contract". If the merchant and you agree that there will be a reasonable (within state statutory law - usury) charge for credit card processing over and above the issuer's rate, it is a legal contract and enforceable by the small business merchant if you agree. Afterall, you have the right to shop elsewhere. Surprisingly, that merchant has the right not to serve you - freedom of contract.
