Question about purchasing a new truck

My boyfriend bought a truck online out of state, not the best idea but could not find anything around NC even worth looking at. He has received the truck but there was a crack in the windshield and they also advertised the truck as a non-smoke!! and when it got here that definitely was not the case it had been smoked in ALOT and he is highly asthmatic. They told him they the would sent him a check to fix the damages and then told him they had sent it out. so when he didn't receive it a week later he contacted the dealer and they told him he was getting no money and when he brought up the non-smoker thing the dealer laughed at him and said sorry that's your problem. Is there anything he can do to get some money to fix what the dealership should have already fixed. and what can he do about them false advertising that it was non-smoker?

Please help me figure this out!! Really need to do something about this soon before its to late :/
