A friend of mine and I were playing basketball when my friend's friend came by on his bike. (From now on, the first friend is Friend A and second friend B.) Friend B put his bike on the ground and I picked it up and rode down the road and back with it. When I got back, Friend B's father was standing there and told me I was lucky he didn't call the cops. He then proceeded to force me to give my name and where I lived. He followed me onto my property and said if I touched anything of his son's things again, he would beat me with a bat. Friend A laughed and the guy said that the same goes for him. What I want to know is whether or not I can press charges for assault.
Communicating threats is a criminal offense. One of the requirements of being able to prosecute for that offense is that the "victim" (you in this case) believes that the perpetrator is capable of carrying out the threat and that the victim believed he would carry out the threat. If you believe all of this, you might have a case.
