i did work on a house and in return to use a backhoe for a week , i am done with the said work and the homeowner brought his backhoe to my house , i went to use it and it broke down, it has been three weeks and he refuses to fix it until i do more work for him, i diagnosed the problem and took the machine apart at his request , he said he would buy the parts and i would fix it. he has not bought the part and refuses to until i do more work. i don't want to do any more work b/c i believe he will not hold up his end of the bargain , do i have the right to charge him storage for his machine? the agreement we had was oral but we have txt messaged back and forth the details is this just as good as a written contract, what are my rights?
Your agreement is enforceable even if it is not in writing. If someone leaves machinery on your property without your permission then you have a right to charge storage fees. Good luck.
