Here is the situation. My brother in law pays his exwife child support for their 2 children. She lives in N. Carolina and he lives in NY. The exwife has put their son in a home for troubled teens. My brother in laws insurance is paying for his son to be in this faciity, but the ex is still receiving child support.
If anyone receives the child support , shouldn't it go to the facility the boy is in?
Is it legal for the ex to continue to collect this support when the boy isn't in her care?
It is legal untilt the father goes into Court and tells the Judge of the change in circumstances and gets the Judge to issue a new Order reflecting the new circumstances.
