when doe's a non profit organization in NYS have to pay overtime. After 8 hours worked in a day or after 40 hours worked in a payweek?

According to NY department of labor, for nonprofit companies, and in the case of a non-exempt employee, overtime must be paid at 1 1/2 times the hourly rate for over 40 hours per week (44 for residential employees). You can read more here: New York State Department of Labor - Minimum Wages
