garbage at the curb

I scrap metal from garbage at the curb. Is this legal? When garbage is at the curb does the owner give up there ownership and pass along ownership to me?

I believe that once it is on the curb, it is fair game. They had a big discussion about this in our town during clean-up week. The conclusion my town came to was once the owner puts it on the curb anyone can take it.
