How hard is it to sue a person for defamation/slander. Tried to get in touch with a couple of attorneys for a consult....no one seems to be interested in talking to me. Thinking of taking them to civil court/small claims. My daughter has been bullied on the internet as well as in school...and this person sent out, via text, a very inappropriate photo of my 13 year old. Any suggestions?? (Police and schools are aware and involved already, and they seem to think I have a good case against this person)

Law: Winning a defamation case is a tough row to hoe and most attorneys either do not understand defamation or just don't want to get involved for obvios reasons. Check new legislation. In your case and based on the facts, you will get much more satisfaction in filing a criminal action. Talk to your local DA.

You are most welcome and good luck with your case. As many folks know, we lost a couple of good kids to suicide as a result of internet bullying. I believe this is a very serious issue. This type of bullying is NOT a black eye or a broken nose as I remember as a child. Internet bullying presents emotional and phychological issues that DO NOT HEAL like a black eye.

It is important to remember that for instance, a black eye or bruised nose is a superficial. Teens heal from this stuff rather quickly. Teen's hormones are flying in all directions. They are insecure, trying to figure out in which direction to go and generally are suseptable to peer preasure. That is, teens are very vulnerable to phychological bullying and such bullying can AND DOES LEAD TO SUICIDE.

At my age, I could give a damn less what you or others may say to me on the internet. Let's help these kids and get some good legislation in place. More importantly, lets teach our teens to respect each other on their internet sites.
