You need to get some one on one counseling first. You have been terribly victimized. Sending an "accusation of rape letter" to this person's family is not necessarilly illegal assuming the facts are provable but such accusations will put you in jeapordy of criminal and civil inquiry i.e. open a can of worms against you. Don't think you want that.

In my opinion, you should contact a good civil litigation attorney in New York since you do not want the plubicity and burdon of proving rape in a criminal trial. You can sue this Dude and the burdon of proof is reduced to a preponderance of evidence. Talk to an attorney before you attempt to satisfy your anger via a hate letter to the dude's relatives.

Civil court and the police are the same monster. In both cases, I am going to be scrutinized. In both cases, people at my job will find out and I will need a new job because of the gossip. Plus I don't need/want to recall the gross details of the actual rape, and I don't want money at all.

For the record, it wasn't a hate letter. It's far more rational than this post. I have always gotten the impression that this guy was rather slow mentally. He was nice enough and able to hold a job in a department of our company, so it's confusing to pin down whether or not he is actually challenged. I thought maybe his family has a better insight into his intellectual capabilities or any issues.

I appreciate your help, but maybe acquaintance rape and law just don't mix.
You were raped. Under the law in most states, "Rape is sexual intercourse by a male with a female without her consent". In the old days, the female had to show she sufficiently resisted. The most used defense to rape is you consented. Modernly, "acquaintance rape" is rape if the female in someway does not agree to have sex. For instance, if the female is asleep or so drunk that she cannot consent, she has been raped. Modernly, the male cannot and I repeat cannot enter into evidence any of your past sexual escapades.

I cannot say much more publicly. Consult with a NY Attorney and you find you have options, even keeping your name anonymous. Good luck.

I wonder if you might have a case under the Whistleblower Protection Act (since you aren't the only one and others in positions know of the activity of the rapist but neglected to report it,) in which case you would receive monetary damages & won't have to work at this company. DNA degrades overtime so don't wait too long.

A whistleblower (whistle-blower or whistle blower) is a person who tells the public or someone in authority about alleged dishonest or illegal activities (misconduct) occurring in a government department, a public or private organization, or a company.

The Alleged Misconduct may be classified in many ways; for example, a violation of a law, rule, regulation and/or a direct threat to public interest, such as fraud, health/safety violations, and corruption.

The following are some examples of situations outside the job description.
Sexual harassment, racial discrimination, slander, and stalking.

I did not send the letter or contact him/his family. Instead, I got the names of women he had done this to in the past and reported the rape (initially just to Human Resources at my job) so he wouldn't do this again. He ended up committing suicide, but management at my company was supportive of me during and after the investigation.

Why do that to his family and why would you think he would change his behavior? If you sign your name you could be sued for slander and if you don't (and probably if you do) he will dismiss you as a crackpot and will probably be believed. You don't know the health of the people you're writing to and you might end up regretting it once you put this as far behind you as you can. I too hope you can get some competent counseling, it was rape, and I'm sorry you're going though this.

As per my last post, I did not send the letter. I wrote the initial post when the situation was at its most heated point, emotionally. I have since taken time off work, gotten counseling, reported the rape, and gotten names of former victims. Once I reported it, he committed suicide. I luckily did not send the letter at all, got a lawyer, did everything the legal way, and it worked out in my favor since nobody has to worry about him ever raping anyone again.
