    Default religion in school

    My son came home from a public elementary school with a flyer sent by the district inviting him to a religious institution to join them in celebrating their holiday. Is this legal?

    Your question is not State Based although it is under the NY legal forum. Yes, there have been many conflict of laws as to religious freedom. For instance, the Supreme court premitted a religious group to do an elligal drug - i.e. Payote as part of their religious ceremony.

    Your inquiry is based in constitutional precedence. Your elementary school does NOT have the Constitutional right to promote "THEIR" RELIGION. However, YOU and any other private individual has the right to invite another to "their" celebration. Of course, under our constitution you have the right to refuse to let your son attend.

    Do you see the logic? THE CONSTITUTION IS PROTECTING Y O U! It is giving YOU THE RIGHT TO INVITE ANOTHER TO YOUR SERVICE AND RELIGIOUS INSTITUTION!!!!!!

    I think it does'nt matter at all if you avail the other religions holidays.so enjoy your holidays

    Not sure what you mean by "avail". The issue of Religious freedom is complicated by the concept of Federalism which is raising its "Dragon" head again in 2011 i.e. profiling illegal immigrants and health care (Commerce Clause). We are "living" a renewed revolution with respect to states rights; similar to that which placed heavy pressure on our founders in the 1780's. Remember the 3/5ths clause and the Connecticut Convention? Also remember that in our system of government, the Feds do NOT have absolute power. Each state has a certain amount of autonomy, several states have a certain amount of power, all the states acting together may disolve our Federal Government.
