    Default Benefit Fraud in NY

    Is it legal for my stepmother to hold a benefit in which she collected over 20K to pay off my fathers medical bills if she is not the Executor of his will? I thought that his estate were to pay these things off. Basically she had a benefit in my dad's name raised 20K to put inot her pocket, is this legal?
