    Default Restaurant - Server Error Law??

    Hi,
    I just moved to New Mexico and am curious about a law. I can not seem to find it online... maybe someone can point me in the right direction.

    I am wondering if it is legal for an establishment to make the server pay for errors made or for errors not in direct relation to an error made. Two examples I am curious about: A table that a server is waiting on orders $100 worth of food and then walks out on their tab. Is the server responsible for paying this bill in any way? Second, a server makes an error (put in the the wrong food, forgets to put in an order, etc)... is the server responsible for paying any part of this?

    Is it legal for a restaurant to make the servers pay for mistakes made?

    Yes. Although most restaurants don't practice it, it's absolutely legal.

    The only comparative example is how a lot of young kids (18 coming out of high school) hear about how they can make tons of money working on oil rigs in Alaska but when they get there they learn they get heavy amounts of money taken out of their pay checks for food and shelter. (Something they don't have a choice in.) The military can be the same way.
    Or baseball players can face huge fees from making errors or showing up late to practice. Any business can impose fines as long as there's some kind of reason for it.
