Greetings, All!
just wondering about my rights, if any, to the house my husband is currently buying. (we plan to stay together). the darn woman at the closing company won't put my name on the title (even tho he requested it). she wants us to put it on later (might cost $100 to do it, and take more time). prob it's all ok, but my dear husband has already had a heart attack + add'l surgery. just want to feel secure.
thank you, anyone who is able to address situation.
You really need someone familiar with NM property law. I say this because your concern is the right of survivorship under NM Law. Find out if NM still subscribes to "tenants by the entirety" which is a variation of Joint tenancy with the right of survivorship. You should demand that the deed be filed under joint tenancy with the right of survorship.
I don't know if you are in a gay marriage but I can tell you and others that where gay marriage is allowed, the few states that still subsribe to "tenants by the entirety" right to survivorship will raise havoc with Gay Marriage.
