    Default US Currency question.

    I have a question about paying my ex's lawyer with coins. In a motion steming from our divorce, I was ordered to pay my ex's lawyer $500. I went to his office and offered payment in us currency, in denominations of $50 bills down to US quarters. The lawyer refused to accept the payment. The lawyer then garnished my paycheck, and bank account. I objected to the garnishment, based on the Coinage Act of 1965, and the Uniform Commercial Code, article 3-603(b). My motion was denied. the Judge spicifically told me, I "better learn not to mess with city hall". Whatever that meant.So here is the question, how can a Michigan Circuit Court Judge ignore State and Federal law?

    In general, in the United States it is unlawful to deny the tender U.S. currency for "all debts public and private." That said, the lawyer obviously felt, and the judge agreed that you were being unreasonable in your method of payment. Just like the bank that can force you to roll your quarters before even they will accept them en-mass, your lawyer can deny not the form of currency (U.S. dollars), but the denomination in which it is being delivered.

    All you had to do was go to the bank and change everything to at least 5s and 10s and you would have been fine. It sounds like you were intentionally being a pain, the judge agreed, and now you're paying the price.

    Thanks for the reply, and yes it is true I was not happy about having to pay the $500, but when I was originally ordered to pay it I told my lawyer that I was not happy about it and I am going to pay in ***** pennies. My lawyer said "that was fine, pay with whatever you want, just pay it".
    With that said, does it mean that the UCC article 3-603(b) only applies to situations with a certain intent?

    The UCC only applies to contracts for the sale of goods, it has no application here, where the agreement was based in a contract for service.

    That said, it wouldn't matter anyhow. Here is a snopes article that basically explains the same thing that I stated in my original reply:
