i'm awaiting a summons for underage transporting in amherst now. I gave my friends a ride to the store, I went grocery shopping, they bought beer then went to the hardware store to get copies of a key made, hit the dollar store and left. Detective with ABC pulls us over as part of a sting because i was driving and apparently even though they're both 21 and it was their beer i have to go to court. I've read MGL Chapter 138 section 34c and the $50 fine isn't a problem but i cannot lose my license for 90 days. I'm planning to plead not guilty as a result of this but i am not sure what to do next or the proceedings that will follow the summons. I am only a month and a half shy of 21, both my friends running errands with me were 21. The detective told me i'd waste 15min of my life and get a slap on the wrist, i dont really consider a license suspension a slap on the wrist. This was not a straw purchase and no money or beer changed hands. I was grocery shopping and they also went to the hardware store to get copies of keys made so i'm hoping the circumstances will be helpful in proving that this wasn't some scheme to provide alcohol to me but rather an accident. None of us were aware of the law, we had been taught in driver ed and so on that as long as someone was 21 riding with you it was legal. Has anyone been through this or have any advice on how to argue?
