So my wife and I took a cross collateral loan from then Chevy Chase bank for the purchase of land and construction of a house. Before anything was signed we made it contingent upon me building the home my self, physically. Chevy Chase bank agreed and nowhere in the Deed of Trust did it stipulate who could or could not do the contruction. After the purchase of property, permits, basically everything short of building the house we got our structured payment sheets. Within the documents it stated I could not be on the property unsupervised without a licensed contractor. I contacted the bank and they gave me this story about what if I got hurt during construction even though I was fully insured for their benifit. So in order to proceed I was forced to get a seporate contractor otherwise I would be forclosed on as the security was my principal residence. So we called every contractor and only one qualified said the bank. After 2 weeks the contractor accepted the job if he could install an elivator?? Yes, you heard correctly an elivator! We were forced into it. The contractor agreed at a set price because the house was a prefab log cabin 6 week turn key job. The next day the contractor called and said that he made some error in finance and we would have to give him more money. I told him this is what we agreed to and I could pay for the extra things out of pocket. The contractor did not accept that and asked me what I qualified for on my loan. I told him that was confidential and I felt he was receiving fair monies for 6 weeks of work. The contractor called the bank with out our concent and asked them what we qualified for and THEY TOLD HIM. The contractor boosted his quote from 125K up to 400K. I called Chevy Chase bank immediatly to inform them of their blunder. They cancled the Work order and said we owed them 393K. Our house mortgage was 155K and the property was 103K. Belive it or not Quicken Loans helped us reduce that to 284K. This all happened in 2007-2008 and need to know if anything can be done.
