CUSTODY IN KY

I want to file for custody for my son but my name isn't on the birth certificate.

I live in GA while my son's mother and my son live in KY.

I have been paying child support since 2007 he was born in 2005.

He has been getting into A LOT of trouble in school. Last year he was suspended from school 7 times!! This year is even worst. He has been written up 21 time since the school year started back in August. His teacher and guidance counselor have told me that they will give me any information I need to help him.

How do i file? Can I file? I don't have enough money for a lawyer. How can I file by myself?

Are you just paying her child support through the courts, or just to her directly? If there is no court order, then you have been giving gifts and not support. She can still file on you for five years of retroactive support. Have you ever determined paternity? Over 30% of the tests come back negative.

Even if paying through the courts, you have no presumed rights to the child, so you will need to file for them.

You have a multiple fold problem, the greatest of which is that you live in a difference state. You may get awarded custody, but not take the child out of Kentucky. We will need to discuss this further.
