Hi, I had a house built 10 years ago but builder never finished a number of jobs and never came calling for the final payment (one third of full amount). He came knocking on the door the other day and is looking for the final amount. Does the Statute of limitations now apply such that I can tell him I no longer have to pay as he did not fulfill our contract back in 2003?
Any advice would help.
It is very clear that the bulider is guilty of Voidability of Contracts from your description.Therefore you should not make any payment now.
