duke the lab

A man has been harassing my family for months. It started when he let his dog defecate in my yard. My dog duke ran up to smell the dogs poop in our yard when the man the kicked my dog. Animal control was called by the man and i was cited for a dog at large and Fear of attack. The man nor his dog were bitten but his dog had a small scratch on its nose. It was his word against mine. We have had several run ins since then. November 9th my 8 year old daughter was walking Duke home from the park when this guy called him away from my daughter by saying here boy and snaping his fingers. She could not hold the leash any longer and Duke ran up to the man and he the pulled out a knife and stabbed my black lab duke in the neck, nose and chest. Duke received 4 stitches and some glue. The man was arrested on weapons charge( 6" usmc k-bar knife). I was cited by animal control for dog at large and fear of attack again. I have letters from our dog breeder, our vet, county sheriff, local k-9 police officer, all surrounding neighbors, dog sitter and many friends that duke is non aggressive. Duke has never bit him or anyone, but he is claiming "fear of attack" and is having him placed on the danger to society list. I am appealing this ruling but he is also suing me in small claims court for $1200 for injuries from kicking my dog . I want to counter sue but don't know for how much or what grounds. Help!
