Is it illegal to download unavailable music? If you can't buy the CD or find a song on itunes or some other pay for music site, then would it be legal to download off of the internet?

even if some songs are really old or even if the artists stop singing it, downloads should be with permission. but nobody cares anyway if you download it via the net.
There is a licence called Creative Commons that allows you to download this kind of stuff. You can read about it on Wikipedia:

Also the licence can be read about on creativecommons dot org. And an excellent place to start downloading CC material would be archive dot org.
