Sec. 38-5. - Public indecency.

(a)
Defined. A person who knowingly or intentionally, in a public place:

(1)
Engages in sexual intercourse;

(2)
Engages in deviate sexual conduct;

(3)
Appears in a state of nudity; or

(4)
Fondles the genitals of himself or another person;

commits public indecency, an offense.

(b)
Nudity means a showing of the human male or female genitals, pubic area, or buttocks with less than a fully opaque covering, the showing of the female breast with less than a fully opaque covering of any part of the nipple or areola, or the showing of the covered male genitals in a discernibly turgid state.

Sec. 38-6. - Indecent exposure.

It is unlawful for any person to expose or exhibit his sexual organs in any public place or on the private premises of another, or so near thereto as to be seen from such private premises, in a vulgar and indecent manner, or so to expose or exhibit his person in such place, or to go or be naked in such place; provided, however, this section shall not be construed to prohibit the exposure of such organs or the person in any place provided or set apart for that purpose.
