3. Tenant's use and upkeep:  Tenant will (d) keep all plumbing fixtures and appliances in the apartment as clean as possible<br />

4.  Landlord's duties:  (d) maintain in good, safe working condition all... plumbing.<br />

The lease also has a clause where the Tenant is to pay the first $100 of any repair at the Premises.<br />
<br />
If there is an occasional leak in the plumbing, and the Tenant will only allow a plumber to come if she doesn't have to pay the first $100 for its repair, otherwise they're OK with it as it is, does the Landlord have to come and have it fixed anyway?  Or is the Tenant waiving the Landlord's duty for this issue?<br />
<br />
I would guess that if the Tenant says not to have someone come fix it if they're going to be charged, and something more catastrophic occurs, the Tenant's insurance would cover the cost of the damage.<br />
<br />
But I'm no lawyer, which is why I'm posting here.<br />
<br />
Any ideas?<br />
