I have a question regarding a friend of mine.<br />
<br />
She's about 35 and has a son of 10. She is unfortunately a battered wife. Her husband abuses her mentally, psychologically and even physically some times.<br />
<br />
She is a housewife. Her husband is pretty rich but she completely depends on him. That's the way he likes to control her.<br />
<br />
Now, she is contemplating divorce. But the questions she has are pertaining to two things :<br />
<br />
1) Is she entitled to an alimony? if so, what can she expect? Is it going to be a single big settlement or monthly payment?<br />
<br />
2) Who will have the custody of the child? He is dangerous and abusive. But he hasn't hurt the kid in any way. How will the child custody be decided.<br />
<br />
Please help. She's kind of desperate and cannot really afford a lawyer. Also, being so timid and shy, she doesn't dare to ask these questions from anyone. <br />

A weird situation needs your legal advise. A friend has an investment property in south California which was sold by the real estate agent he hired. Everything was smooth until the close. After the close, it was surprised to find by the buyer agent that the keys in the box could not open the door anymore. It found out eventually that someone broke into the empty house, replaced all the locks and let a lady live in there with a mattress. After the police arrived, the lady claimed that she rented the house from an obviously fake owner using a prepaid phone-card # in the illegal rental agreement and she also paid the rent in cash to the guy. After the fake owner took her cash payment, he called a &quot;lock smith&quot;, broke into the house and replaced all locks in front of her face. <br />

Even though the illegal Lease Agreement was used by the lady which has nothing to do with the house owners (including seller, buyer and any real estate agents hired for the transaction), the police officers still thought the &quot;break-in&quot; lady had to be treated as a legal tenant based on the California law. The justification was that nobody had seen her to break into the house. The police offers asked the owner to allow the &quot;break-in&quot; tenant staying in the property and seek the civil legal process to resolve it. Then the simple issue became complicated after the enforcement mandate. The &quot;break-in&quot; tenant refused to move out by herself or rent the property, and it left the property owners only option to go through the California legal process and evict her out of the property in a few months. However, this process is time consuming and expensive to the property owners. Also, more importantly, it posted a huge risk to the property owners that the illegal and untrusted tenant could greatly damage the property anytime.<br />
<br />
For the following, I would like to have your advise from the fellow members here in the forum:<br />
<br />
(1) What is the definition of legal tenant per California Laws?  The &quot;break-in&quot; tenant, who has no Residential Lease/Rental Agreement with former and current property owners, will be treated as legal tenant or not?<br />
(2) What will be most efficient legal path to get this situation resolved without too much harm to the property owners? <br />
(3) Also, if possible, get the bad guys punished? Remember that the &quot;break-in&quot; lady herself could be part of a &quot;criminal&quot; ring.<br />
<br />

<div>I need help finding a penal code or tort violation for an illegal civil battery that sends EMF signal to batter individuals physically or sexually, supposedly for purposes of law enforcement.  It is an Electro-magnetic frequency signal to the penial gland to the brain that may cause auditory or visual hallucination.  When I had last looked up the case I found that the judges comments on it were Blue by Day White by Knight.  The crime was punishable up to a $1,000.00 fine or up to a year in jail, ten years with physical harm from the battery and up to life imprisonment with sexual abuse.  Common signals to the supposed law enforcement battery electro-magnetic frequency are chuck, kluck, tinkerbell, pencil, eraser, choclate love, heart, chicken , high nickle and dog ears and nose.  The most common frequency signal that should be well known is tinkerbell.  I need a penal code or tort number.  I lost the number last I looked it up and have been unable to recover it in the books and Lexis Nexis, any help is most appreciated.</div>

<div>Anyone know if two owners of an automobile are equally responsible for injuries in an auto accident in State of California?  One of two owners was not in the car at the time so it appears to fall under the permissive user statute.  I assume I need to find out if the other owner is also a registered owner?  Are both parties obligated to carry insurance on the vehicle?  I have sustained serious injuries and one of the policies is not enough coverage.  Can I go after the other owner on record for my injuries as well?</div>

<div>I discovered after asking my current lawyer for the defendant’s Answers to Interrogatories on Dec 2012 (I am plaintiff) in my legal case that there was another owner of record for the automobile which caused my injuries in a car accident deemed 100% fault of the other driver.  This was never disclosed to me by my present attorney.  I have just recently discovered it by retrieving the defendant's Answers to Interrogatories at the request of another attorney I was referred to so he can review the handling of my legal case because I am now not certain it is being handled in the best interest of myself.  Oddly enough this turned up and it caught the other attorney's eyes as well.  Especially when I was never told there was more than one owner to the automobile.  Could the other owner of a vehicle whether they are registered or not legally be liable for my injuries as well?  I have suffered a couple of serious injuries for 1.5 years, have done many different therapy treatments and I am still to this day being medically treated.  May require a surgery also is what I found out the other day.   Shouldn’t my lawyer’s office have found out who this person is, the relationship to the driver at the time of accident and notified me of its findings?  The policy of the defendant who injured me is insufficient for my wage loss, medical expense and any pain and suffering I’ve been going through for 1.5 years non-stop.  Should I fire my existing attorney and go with the attorney who said he would take over my case and get the investigation going as to who the other driver is and what are the legal responsibilities of that driver.  Told me there may or may not be another policy because of the other driver who owns the vehicle with the driver who caused the accident but that it was in my best interests to check it out.</div>

A motorcyle officer drove past me on the driver's side, saw that I was on my phone, then zoomed in front of me and to the right of me, he was now on the right/front side of me. He pointed at me and told me to pull over. <br />

Of course panic set in and I didn't really know where to go as it was a busy street in rush hour traffic, with no shoulder to pull over unto. I pulled into the right turning lane, in front of his motorcycle. His motorcycle was now behind me, blocking traffic. He came up to my driver's side window. I rolled down my window and was still in drive. He told me to put the car in park. Asked for my driver's license. I was shaking. I recently had to renew my license and couldn't find it. He saw my old expired license and pointed to it and said something to the effect of, the one with CALIFORNIA on it. I gave it to him and said it's expired, I am looking for my new one. He was clearly in a hurry. He asked if all my information from the expired license was current. Clearly, so that the ticket could be sent to my current address. As he was writing my ticket. I was really nervous about where we were located. Blocking traffic. My niece was scared and asking me If I was going to go to jail. <br />
I said &quot;excuse me&quot; to the officer, he was by his motorcycle. He said hold on or one second. I told him I do not feel safe and asked if we could drive somewhere else. He said he was done, all I had to do was sign the ticket. I didn't want to, of course. I didn't feel okay. So, he said where do you want to go? It was a busy street and no other safer place was closer. We ended up driving to a different place. I was now in the right hand turning lane (Where he pulled me over) and he was next to me telling me to go left. I didn't want to cross traffic, so I went right. We were then in another right turning lane and at a red light. He told me to go straight and to a parking lot. Then changed his mind and said pull up behind a van on the side of the road with a shoulder. I think it was actually a bus stop. I felt a little better. <br />
I then gave him my new ID. As we were driving to the new location, he had my expired ID. He asked for proof of insurance. I finally signed the ticket. :( He then asked if I had a good driving record. I said yes. He asked where I was going and told me to make a U-turn and that he would stop traffic. I didn't make a U-turn. I stayed there and called my sister who was calling me looking for her daughter whom I had picked up from school. He drove off. <br />
<br />
I want to know what the procedures are for a traffic stop. Did the officer follow procedure? Is there anything I can do about power trip officers that just want to meet a quota? :mad:</div>
