Is it legal to upload a home **** movie that you made with your partner willingly. At the time she knew she was being filmed, had no problem with it, enjoyed it, encouraged it and there was no regret expressed in doing it.
Fast forward a little. Now you want to upload that video to an ameture **** site. Do I need the girls permission? If I post it without her permission and she somehow found out about it could I face legal problems? This is a completely serious question, and serious knowledge would be appreciated, thanks. |

It would be best to have the subject sign a release of any right in the use of the videotape. A signed release indicates tacit approval of the video. That should protect you from being sued for invasion of privacy.

I think that if you consider how many similar videos are online, it may be misleading. I wonder how many of those are illegal, but aren't followed up on because that would cause more embarrassment to the subjects?
I agree that a signed release would be the best way to go.
