I was seeing a therapist in Mississauga Canada and shortly after my last visit , I was brought to court over a child custody issue. There was a sworn affidavit stating that my therapist had divulged information about my past history and I believe this breach of confidentiality has damaged my case and caused me a great deal of pain and suffering due to the final outcome. Is this "breach of confidentiality" legal? and are there any penalties that the therapist may be forced to pay because of this?
Hi: In dealing with my things two years ago, it was necessary for me to consult with employment and emotional counciling people. On both sides it was strickly put to me that these people were strickly forbidden to even discuss matters involving me with each other under the Privacy Act, without my taking the time to provide all sides with written permission from me protecting them from litigation. In Ontario, by the way. A therapist is, of course, not bound by confidentiality in reporting of a criminal act in progress. Short, deep doo doo for therapist to discuss your problems, period. With others I have talked to, [ you would be suprized ], the complaint is that Govt. authority has been abused and even human rights offences committed to create favoritism to one parent and malign the other, with no concideration for the best interests of the child. What I think you should ask yourself is why risk trouble to involve the Therapist improperly in the first place and look more to the bottom of why. Would you not think that if an educated man who knows the rules, risks getting in trouble with how he makes his living, has a motive, and possibly someones protection. Your business, but thought you might like to know problems in this area are much larger than you might think. Suggest caution, and it might help to know others have been subjected to much worse, and working to fight back. Why not try emailing Premier McGuinty. Subject might not be much of a suprize to him.
