    Default traffic law

    In canada is it legal to drive into a vehicle that is NOt moving in a line of trafiic? going by one insurance company it is legal to do this even if the accident can be avoided.

    Exclamation update

    it is legal to drive into someone that is parked on the side of the road or has broken down inn the middle ofthe road. At least in alberta anyways. This is what I found out having completed a personal injury claim in ther city of edmonton. NOw I do not know how predjuice the province is, but it sucks when the othere party could have avoided the whole thing by moving into one ofthe vacant lanes. So inthe edmonton area it is legal to drive into someone. I hoping this happens agian and I am the one that could not avoid the accident.:

    Your question is hard to understand. A driver has a duty to avoid accidents, period. It does not matter much if the other driver is stupid or if the other car is not moving. Generally, the person who has the last clear chance to avoid an accident has aduty to try.
