I live in Alberta, and go through Rogers for my phone company.
I have been having a sizeable amount of difficulty with my phone, and have been waiting for it to crap out so i can get them to give me a new one.

However, as of about a month ago, it came to my attention that during one of my many services being done to my phone (where it was sent away and the software was reset and sent back to me), it appears Rogers signed me to a new 3-year contract.
At the time, i was already in my second year of the contract (due for a new phone next september), and according to Rogers i was given a *brand new* phone, thus making it ok to reset my contract and put me on a new 3 year contract.
I have the specific work order saying my phones software was reset, and that i was NOT in fact given a new phone, aside from which i never signed anything in agreement to reset my contract, or even to send it away for that matter (all i had to do was provide my ID).

I am unfamiliar with contract law, but something about this screams illegal to me. Could i technically threaten them now to provide me with an ACTUAL new phone now, considering i am being forced to endorse a contract a had no part in signing? The alternative of course being to take legal action against them?
