    Default CAS

I have children that CAS has taken from me for a reason which the police wouldn't lay charges for, they have not given me a Service Plan as they dont want me to have the children. It has been five months, one is still in an abusive foster home and they are now split up. The situation is very bad for them. I am a devout loving father, my wife has had a nervous breakdown over this. I have not been able to find out one single thing about my case. CAS won't respond to my lawyer. I am told to wait for trial in 14 months. I have exhausted all savings, RRSP's everything I have worked for is gone. I am desperate but I have realized I must become emotionally detached to work with the situation. I have one question, what is the penalty for taking my children to another province.

It could be considered kidnapping; interference with law enforcement; violation of Court Orders; contempt of court. Get another lawyer, too. Good luck.

I was actually hoping for some more indepth information alluding to habitual residence. The CAS in Ontario would have no authority outside their jurisdiction because the children are not habitual residents. Am I missing something here. Also the implications once they were re-established.
