First, I am a citizen of the U.S. I have recently become aware that my work was being made publicly available to the worldwide web on several websites, one of them being a Canadian one.

I have contacted the relevant, Canada-based webmaster of the site in question numerous times, at first regaling him the DMCA notifications of copyright infringement (which was done completely in vain because north of the border, of course, the DMCA does not hold).

I finally read up on Canadian copyright laws and have found that as a citizen of a country bound by the Berne Convention, among many other international copyright agreements, I am inherently protected by Canada's laws as the original creator of these works. (Please correct me if I am wrong.) I have just emailed the webmaster notifying him/her of such and to please remove my works from his/her website immediately.

I hope that s/he will be responsive, but in the event that s/he is not, what are my options? How long should I wait? Is there anything else I can do? And how difficult is it to pursue legal action in Canada, being a U.S. citizen?

Thank you.
