I am currently doing weekends. It was ordered by the court to be at a local RCMP Detachment by 7 pm firdays, and released 8 pm saturdays. The last couple weekends, they released me at 8:30 pm and 9:40pm. I have never had any problems while doing my time. I questioned the cop when he released me at 9:40 pm, and was told that they will release me when ever they feel like it. I was not allowed any communications to family or the likes for the time I was held past 8 pm.
If I don't show up at 7 pm, I most likely will be charged for unlawfully at large and maybe breaking an order made by a judge. All very serious charges. Does anyone know what recourse I have with this unlawful detention? Is there something I need to do, go to court and explain that I am not being release as order? File a lawsuit? File complaints? Any advice would be very helpful, Thank You.
I'm pretty sure this a violation of my charter of rights.
