4 people own property equally as tenants in common. One of the owners wants to buy the others share. they do not want to sell. Can they be forced to sell their interest.
In Canada tennants in common all own a portion of the property. Example: each of 4 tennants own 25%. In Joint tennancy all own 100%. Example: each of 4 own 100% each. This is not mathetically possible but it is how th elaw views Joint Tennancy. You have tennants in common. Each of the 4 own a proportion - ie 25% each. One owner cannot force any other owner to sell.
