is is legal for a county judge (NOT CRIMIAL JUDGE) to issue a burn band for his county as an executive order?
how would the public know about the order
it is not in paper, on the tv, not on the raido
does it go in effect as soon as he signs it---does it have to be recorded at the county clerk office ? does he have to have a hearing on this order if one is requested ? what does burn band mean no out side burning?
no grills for burgers, no cutting torch a welding shop? order just says burn band. or it just a bluff
A burn ban can be issued by the county judge anytime he feels the weather is dangerous for outside burning. This does not include grills and such. Mostly it's talking about burning brush, leaves, bonfires, etc. You can call your local dispatch center to find out if a burn ban is in effect or not. I work for Benton County dispatch, and when a burn ban is in effect, whether a long basis one issued by the judge or a 24 hour one issued by the department of emergency management, it is also listed on our county website. We require all people to call into our dispatch before burning, so that we can advise if there is a ban or not. Some fire departments will issue their own area burn bans when the wind is high or the weather is particularly dry. Sometimes one will be put into effect after a few control burns have gotten out of hand and had to be put out by the fire departments.
