Received a computer shipped to my son in error. We incurred shipping charges (A) from his school to our home since he didn't want to leave it unsecured over the holidays. Repeated calls to Dell requesting a manager to resolve the issue were 1) numerous, 2) switiched to reps who were frustrating to say the least, and did not provide acceptable closure. Now, i need to have some insight into the following:

Does he have any legal responsibility to return it even if they request it and they are willing to pay return freight. Does ownership pass to him for this error.

If not he can't legally keep the PC, can we recover specific refund of (A) above and (B) a charge for our inconvenience in this matter. If (B) is a yes, then how much is reasonable.

Can they legally charge my credit card (used for a previous computer purchase) for this and prevail in the credit card chargeback process.

It is rather safe to say that if you did not order something, you cannot be forced to buy it. The error occurred on their part, so they should be responsible for all charges.

I think they should be responsible for all reasonable charges. YOu must be an honest person to call and say you recieved a computer that you didn't order and then give them your name. Most people would have pretended they never got anything.

Well, you had done the right decision so far. You have the legal responsibility to return it even if they request it but you can also have option of getting a similar amount of money for the fault they made. However ownership doesn't pass over you at this case.

I don't see any reason why your son could legally keep the computer. Sounds a bit selfish and greedy if you ask me.
