Im currently living in Illinois with my 1yr old daughter. I was recently granted a divorce and sole custody. I have an opportunity to move to California so make a better life for both of us, however her father (who currently is in jail) refuses to sign anything giving us the right to move and i am on a rather tight budget right now so a lawyer is pretty much out of the question. what could happen if we moved anyway? could the court force me to come back or would my ex have to start court procedings to get anything done? or since i have sole custody is there anything that they could do at all?

This is sticky. If your divorce\dissolution decree does not require you to get court or husband's approval before leaving the jurisdiction, then leave. Just be sure to fortify yourself legally by: sending a registered letter to the judge saying where you are going, when and why; similar registered letter to your x. Then go.

There are agencies which you can go to for assistance in this matter. This should save you on the lawyers fees.

It would really help to NAME some agencies for this poor woman to start looking...
