View Full Version : Laws regarding drug possession charges for other members residing in home?

This is a roommate situation in which a single mom has rented a room to make ends meet. It's been about 9 months since the person/renter has moved in and it's now become obvious that he's been dealing drugs. The single mom cannot even come close to meeting expenses without renting the room (cannot at this come up with funds to return security deposit).
What happens if an arrest occurs and the mom residing with the drug dealer has nothing to do with the "dealings", but has knowledge of the "dealings"? Does the mom automatically get implicated? How does the fact that she has her child living in this home, knowing there are illegal activities taking place, come into play?

Yes, the woman can get into bug trouble if there is an arrest in the home. Just because she says she wasn't involved doesn't mean that the police will believe her. She will get into some real trouble if she allows this to go on.
Her best bet is to get rid of these people and get new tenants in. She might even consider calling the police herself. She has to protect herself and especially her kids. Why does she allow them to stay with her kids in the home too? She might need the money but things will get much worse for her if she allows the situation to continue.
