My husband and I have worked for the same company for a little over four years. We worked for three years and then left and now we have been back for just over a year. We are both full time status workers. We have given this company 100 % of our blood sweat & tears. Recently he hired a husband and wife to work. He is considered full time, she is seasonal. They only do there jobs when someone is there to babysit. Other wise they are surfing the internet which is not allowed and talking on there cell phones. Both of which they have been told not to do. The company is like everyone else laying some people off. My husband and I were called into the GM's office and pretty much asked to volunteer to be layed off because my husband has been thinking about retirement and supposedly I am burnt out. He just doesn't want to lay off this younger couple because he favors them. I love my job. It is the managers I don't like. Should the last people hired not be the first people to get layed off, especially if they are not doing their jobs? Can he lay off loyal older workers over newbees who don't do their jobs? Is this maybe age discrimination?

The problem is that you would have to prove that the manager is picked the younger couple because of their age. It can be hard to prove in a court of law.

I agree with Jimbo. What is the reason they are asking for you to take a voluntary lay-off? I would hope it's not so they don't have to pay retirement benefits to your husband.

Really a company can fire or lay off anyone as long as it isn't discriminatory. It might be hard to prove it.
